Child Custody Lawsuits

A custody case is a lawsuit filed by persons who have not completed the age of eighteen and whose custody has been given to the other parent. The person requesting the custody of their child will demand that the custody be changed and given to him/her. If there is a divorce case between the parties and the parties have joint children, there is no need to file a separate custody case. Custody is an issue that the judge will directly consider while the divorce case is pending. It will decide by investigating whether custody should be given to the mother or father in terms of the child's interests and benefits. For this reason, the party who wants to take custody of the child must convince the judge that it is more beneficial for the child.

The age of the child is also important when it comes to custody. The custody of the children, especially at the infant age, is given to the mother regardless of the mother's financial situation.

 

The mother or father who has taken custody to open the case of changing custody;

  • Preventing the parent who has the right of custody from meeting their child with the other parent who does not have the right of custody.
  • remarriage is a reason to change custody, but not in itself a reason to change custody. If the child's care and interests are adversely affected by remarriage, a decision to change custody will be made.
  • The right of custody will be taken from the parent who goes to another place, abandons his child and neglects his care.
  • In cases such as death, the judge takes the necessary measures on his own or upon the request of the mother or father.
